Terms of Service

These Terms of Service ("Terms") govern your use of Statsbay, an influencer campaign management and analytics platform available at statsbay.com (the "Service"). The Service is operated by Mrinbit, Nayabad, Kolkata 700094, India ("Statsbay", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you use Statsbay on behalf of a company or agency, you confirm that you have the authority to bind it, and "you" includes that organisation.
1. Eligibility
You must be at least 18 years old and use Statsbay for business purposes. You must provide accurate information when you sign up and keep it up to date.
2. Your account
You are responsible for keeping your login details secure and for all activity under your account, including activity by team members you invite. Tell us immediately at support@statsbay.com if you suspect unauthorised access. Each account is for one organisation. You may not share, resell or transfer your account without our written permission.
3. Plans, free trial and billing
Plans. Statsbay offers paid plans (currently Pro and Max) billed monthly, every 6 months, or annually. Plan features, limits and included credits are shown on our pricing page. Prices are in Indian Rupees and exclusive of GST and other applicable taxes, which are added at checkout.
Free trial. First-time customers who choose a monthly or annual plan get a 15-day free trial. One trial per person and organisation. Claiming more than one trial is a breach of Section 5 and may lead to termination without refund. We may also refuse or end a trial if we believe it is being misused.
Renewal. Paid plans renew automatically at the end of each billing period at the then-current price, unless you cancel before the renewal date. If you provided payment details during the trial, your paid plan starts automatically when the trial ends unless you cancel before then.
Cancellation. You can cancel any time from Settings. Cancellation takes effect at the end of your current billing period, and you keep access until then.
Refunds. Fees already paid are non-refundable, including for partial billing periods, unused features and unused credits, except where required by law or stated otherwise in writing by us.
Price changes. We may change prices with at least 30 days' notice by email or in the app. Changes apply from your next billing period.
Failed payments. If a payment fails, we may pause your account until it is resolved.
4. Credits
Some features, such as fetching Instagram and Facebook post data, use credits. Credit costs are shown in the app before you confirm an action. Credits included in your plan reset at the start of each billing month and do not roll over. Purchased credit packs expire 12 months after purchase. Credits have no cash value and cannot be transferred or refunded. If a fetch fails, the credits for that fetch are returned to your balance.
5. Acceptable use
You agree not to:
- use Statsbay for anything unlawful, fraudulent or harmful;
- add personal data about creators or other people unless you are allowed to under applicable law;
- use tracking links for spam, phishing, malware, misleading redirects or illegal content;
- harass creators or use creator contact details for anything unrelated to legitimate business dealings;
- try to access other customers' data, get around usage limits or security controls, or reverse-engineer the Service;
- use bots or automated scripts against the Service, or overload it;
- resell, sublicense or offer the Service to third parties as your own product without our written permission; or
- use the Service in a way that breaks the terms of Instagram, Facebook, YouTube or any other platform whose content you track.
Multiple accounts and promotional abuse. Each person and organisation may hold only one account for the purpose of free trials, free credits, discounts and other promotional offers. Creating or using multiple accounts, or using different emails, payment methods or identities to claim free trials, free credits or promotional offers more than once, is strictly prohibited. If we reasonably believe you have done this, we may immediately suspend or terminate all related accounts without prior notice, cancel any free or promotional credits, and recover the value of any discounts improperly claimed. To the extent permitted by law, no refund of any fees, subscriptions or purchased credits will be given for accounts terminated under this clause.
6. Your data and responsibilities
You own the data you add to Statsbay ("Customer Data"), such as campaigns, creator details, spend, conversions and revenue. You give us permission to store and process it only to provide and improve the Service, as described in our Privacy Policy.
For personal data about creators that you add to Statsbay, you are responsible for having a lawful basis to collect and use it, and we process it on your behalf. You are responsible for the accuracy of the data you enter manually.
7. Third-party platforms and data
Statsbay relies on third-party services, including YouTube API Services, Apify and payment and hosting providers. By using Statsbay's YouTube features, you agree to be bound by the YouTube Terms of Service.
Public post data and metrics come from these third parties. We do not guarantee that they will always be available, complete or accurate, and a platform may change or limit access at any time. If that happens, we may change or remove affected features. Where this materially reduces your paid plan's features, we will try to give notice and a fair alternative.
8. Creator connections
Creators can choose to connect their YouTube channel to share analytics, such as promo segment views, with the brand that requested access. Statsbay accesses this data read-only, uses it only as described in our Privacy Policy, and shares it only with the requesting brand. A creator can disconnect at any time. Brands must request access honestly and must not pressure creators through misleading messages.
9. Estimates and metrics
Calculated figures, including promo views, engagement rates, CPV, CPM, CPC, CPA and ROAS, are estimates based on available data and the numbers you enter. They are provided for information only. You are responsible for business and payment decisions you make based on them.
10. Support access
If you grant support access in Settings, our support team may view, and if you allow it, edit your account for the time you choose, to help resolve your issue. Our administrators may also access accounts when needed for security, fraud prevention or legal reasons. All such access is logged.
11. Our intellectual property
Statsbay, including its software, design, logos and content (excluding Customer Data), belongs to us and our licensors. We give you a limited, non-exclusive, non-transferable right to use the Service during your subscription under these Terms. If you send us feedback or suggestions, we may use them freely without any obligation to you.
12. Suspension and termination
We may suspend or end your access, with notice where reasonable, if you break these Terms, fail to pay, create risk or legal exposure for us or others, or if required by law. Accounts terminated for promotional abuse are handled as described in Section 5. You can delete your account at any time from Settings.
After your account ends, you can no longer access the Service. We delete Customer Data as described in our Privacy Policy. Export anything you need before deleting your account. Sections 5, 6, 9, 11, 13, 14, 15 and 16 continue to apply after termination.
13. Disclaimer
The Service is provided "as is" and "as available". To the extent allowed by law, we make no warranties of any kind, including that the Service will be uninterrupted, error-free or that data from third-party platforms will be accurate or complete.
14. Limitation of liability
To the extent allowed by law, Statsbay will not be liable for any indirect, incidental, special or consequential losses, or for loss of profits, revenue, data or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim.
15. Indemnity
You agree to compensate and protect Statsbay from claims, losses and costs (including reasonable legal fees) arising from your Customer Data, your breach of these Terms, or your violation of any law or third-party rights.
16. Governing law and disputes
These Terms are governed by the laws of India. We will first try to resolve any dispute informally. Write to us at legal@statsbay.com and we will respond within 30 days. If a dispute is not resolved within 60 days, it will be settled by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed by mutual agreement. The seat of arbitration will be Kolkata, and proceedings will be in English. Subject to this, the courts at Kolkata have exclusive jurisdiction.
17. Changes to these Terms
We may update these Terms from time to time. We will post the new version here with a new effective date and notify customers by email or in the app at least 15 days before significant changes take effect. If you keep using Statsbay after that, you accept the updated Terms.
18. General
If any part of these Terms is found unenforceable, the rest stays in effect. Our not enforcing a right is not a waiver of it. You may not transfer your rights under these Terms without our consent. We may transfer them as part of a merger, acquisition or sale of assets. These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Service.
